  • GENERAL CONDITIONS OF SALE

    1. Commercial policy

    1.1 Salsa or Irmãos Vila Nova, S.A. or IVN, hereinafter called the “vendor”, has products for sale at the www.salsajeans.com website, and its e-commerce services are available to consumers only.

    1.2 A consumer is defined as any individual who buys the products sold by the vendor for their own use and not for professional use.

    1.3 All individuals or companies that intend to acquire products for anything other than own use may not make purchases at the online sales website www.salsajeans.com.

    1.4 The vendor reserves the right not to process orders received from users that are not considered consumers under the definition in these general terms and conditions of sale, as well as those orders that do not comply, and consequently, they do not accept the vendor’s general terms and conditions of sale.

    1.5 These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of orders placed at www.salsajeans.com by consumers in the Salsa online (www.salsajeans.com) shop from the vendor.

    1.6 The consumer must provide the vendor with an email address, or data on another means of contact that are correct and complete, and agrees that the vendor may contact them using these data if deemed necessary.


    2. How to order

    2.1 To place an order at www.salsajeans.com, the user must have an active email account and their browser must be set up to accept cookies and pop-ups, so that they can enjoy all the browsing features in the Salsa online shop.

    2.2 Placing an order at www.salsajeans.com is easy:

    2.2.1. Find the products you want to get;

    2.2.2. Add the selected products to your Shopping Bag;

    2.2.3. Finalise your purchase;

    2.2.4. Select the payment option;

    2.2.5. Check your order;

    2.2.6. Make the payment and confirm your order;

    2.2.7. You will be sent an email confirming your order.

    2.3 The order is considered to be confirmed when the user selects the “Confirm Payment" (Checkout) button at the end of the purchasing process.

    2.4 When Salsa receives the order, a message appears on the screen with the order number and the details of the order.

    2.5 The purchase and sale contract is considered to have been finalised when the consumer receives the information on the order number and the details of the order.

    2.6 Once the process referred to in the previous paragraphs has been concluded, a confirmation of the order is sent to the consumer's email. Consumers should then print or download the information received.

    2.7 The vendor reserves the right not to accept an order, and can cancel it even after automatic order confirmation.

    2.8 By sending the order form, you are agreeing to the general terms and conditions of sale, as well as other conditions available at www.salsajeans.com, through links, including the general terms and conditions of use.

    2.9 The vendor may decide not to process orders when there is not a sufficient guarantee that payment will be made.

    2.10 When orders are incomplete or incorrect, or the products ordered are no longer available, the consumer will be informed that the contract of purchase and sale was not concluded, indicating the reasons for this decision.

    2.11 If the products presented in the online shop (www.salsajeans.com) are no longer available when the consumer last accesses the website or when the vendor receives the order, the vendor shall inform the consumer of their non-availability within 30 days of receipt of the request.

    2.12 If an order has been placed and payment has been made for products that are no longer available, the vendor will return the money paid for the items that are not available.

    2.13 Right not to accept an order or to cancel a purchase

    2.13.1 Salsa reserves the right to refuse any order for any reason.

    2.13.2 The vendor also reserves the right to cancel any purchase (even if it has been accepted), and shall bear no liability for any damages caused or costs incurred, particularly in the following situations:

    (i) The product is not available/in stock, in which case payments made will be returned;

    (ii) The invoicing information is not correct or cannot be verified;

    (iii) The order is flagged by the vendor’s security system as an incorrect order or an order that could be fraudulent;

    (iv) The transfer for payment of the order was not received by the vendor within five days of its acceptance of the order;

    (v)If the consumer is aged under 16;

    (vi) If the consumer acquires goods for resale;

    (vii) It was not possible to deliver to the address provided.

    2.14 Data verification

    2.14.1 After receipt of the order, the vendor may carry out checks on this before beginning its preparation.

    2.14.2 These checks may include verifying the address, creditworthiness and the existence of fraud.

    2.14.3 In terms of fraud checks, partially automated checks are carried out on all orders placed, making it possible to filter transactions that are unusual, suspicious or identified as being susceptible to fraud.

    2.14.4 Suspicions of fraud will be investigated and, if necessary, prosecuted.

    2.14.5 By confirming your order, you are agreeing to these terms and conditions.

     

    3. Guarantees and Product Pricing

    3.1 Payment methods

    3.1.1 The payment methods available can be found in the Help/FAQs section of the website.

    3.1.2 We do not accept any payment methods other than those mentioned, and payment is not possible by any means other than those specified.

    3.1.3 If the consumer decides to pay by means other than those indicated, the vendor may not be held liable for any loss of the payment or any other damages that may arise from this.

    3.2 Payment processing

    3.2.1 If payment is made via credit card, the amount owed will be deducted from your account as soon as your order leaves our warehouse.

    3.2.2 If payment is made by credit card, all the details, such as the card number or its validity date, will be sent via encrypted protocol to the company that provides remote electronic payment services, without third parties being able to access the information transmitted.

    3.2.3 This information will only be used by the vendor for the purpose of carrying out the procedures necessary for the payment, or refund in the event of a return, in accordance with the exercise of the right of return, or to notify the police in the event of fraud.

    3.2.4 The purchase prices of the products and the transport costs, as indicated in the order form, will be charged to the current account when the products purchased have actually been shipped.


    4. Order security

    4.1 The www.salsajeans.com shop uses some of the most robust security technology from the encryption platforms available.

    4.2 The payment information will be encrypted from the moment the user logs in and until the transaction is processed, and will not be kept on a public server.

    4.3 Although the vendor uses encryption software, the security of information transmitted and payments made via the internet or email cannot be guaranteed.

    4.4 The vendor may not be held liable for any damages incurred as a result of using electronic means of communication, including, but not limited to, losses arising from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications, or virus transmission.

    4.5 If the consumer chooses to pay using a Multibanco reference, processing of the order will begin after receipt of the payment by the vendor.

    4.6 If the vendor has not received any payment within five calendar days of the order being placed, the order will be cancelled.

    4.7 Payments may only be processed if the information to be used for invoicing can be verified.


    5. Retention of Title

    Salsa shall retain ownership of all products until they have been paid for in full.


    6. Pricing

    6.1 The product prices shown at the website include Value Added Tax (VAT).

    6.2 Shipping fees are applied to each order placed by the consumer.

    6.3 The exact price of shipping will depend on the country the order is shipped and delivered to.

    6.4 Shipping fees for each country the vendor delivers to can be found in the Help/FAQs section of the website.

    6.5 All prices are in euros.

    6.6 Prices may be subject to change, due to transport costs, depending on the country the order is to be delivered to.

    6.7 The total price specified in the final checkout menu includes taxes and shipping costs.

    6.8 The prices are given at the time of confirmation of the order, which can be printed out or downloaded for future use.

    6.9 The exact amount specified in the order confirmation must be paid.

    6.10 Each order must be paid for separately.

    6.11 The product prices shown at the website are subject to change.

    6.12 Salsa reserves the right to change the prices without prior notice.

    6.13 The prices shown at the time of purchase are the prices that will apply to that purchase.
    6.14 Although website updates are done very carefully, it is possible that pricing information at the website may contain errors.

    6.15 Salsa shall not be bound by issues such as this, and reserves the right to cancel your order if an error should occur.


    7. Quality and Guarantee

    7.1 Salsa only sells new products.

    7.2 Salsa does not sell products with defects or of a quality lower than existing standards on the market.

    7.3 The main features of each product shown at www.salsajeans.com can be found on each product page.

    7.4 The products offered for sale at www.salsajeans.com may not correspond exactly to the actual clothing in terms of image and colours due to the internet browser and monitor used.

    7.5 All products have an identification label.

    7.6 The label may not be removed if you want to return the product.

    7.7 If you decide to exercise your right to return the products bought, Salsa has the right not to accept the return of products without their labels, or products that have been altered in relation to their original condition or damaged.


    8. Shipping and Delivery

    8.1 Products are delivered from Monday to Friday.

    8.2 No products are delivered on public holidays.

    8.3 We can only deliver orders if the shipping address is a house or an office in one of the countries on the list of countries in the Country menu.

    8.4 Somebody must be at the delivery address to accept the order.

    8.5 The delivery service does not include a scheduling or booking option, which means the order will be delivered without prior contact from the carrier.

    8.6 The delivery period is not assured during promotions or sales, at Christmas or when stock runs out.

    8.7 The order is considered to have been delivered when the delivery receipt is signed at the agreed address.
    8.8 If you confirm your order by midday on a business day and make your payment using a credit card or via PayPal, your order will be sent on the next business day (weekends and public holidays are not considered to be business days).

    8.9 If you choose to pay using a Multibanco reference, the delivery will be made after confirmation of payment, which can take between 5 and 7 business days.

    8.10 The vendor shall not be liable for non-compliance or late compliance with any obligation that is caused by a force majeure event, which is an event, act or omission beyond its reasonable control.

    8.11 Considering that the delivery is assured by an entity external to the vendor, we cannot guarantee compliance with the delivery period.

    8.12 Whenever possible, the order will be delivered in a single shipment.

    8.13 However, we reserve the right to divide up the delivery of an order, for example (but not limited only to this) if part of an order is delayed or not available.

    8.14 If an order is divided up, the consumer will be notified via email of the intention to proceed in this manner.

    8.15 The email address provided by the consumer at the time of purchase will be used for this purpose.

    8.16 On delivery, the customer should inspect the packaging to check for any damage.

    8.17 If the products are found to be damaged, the customer should not accept delivery of the order, which will be returned.

    8.18 Salsa will refund the amount paid for the order and for the delivery as soon as the warehouse receives it and completes the return process.

    8.19 Any complaint about an order not received must be made within 30 days of the date the order was placed.

    8.20 At the end of this period, Salsa cannot be held liable for the loss of the order.

    8.21 There is an option for delivery in a selection of Salsa shops*, which you can find when selecting the delivery method for your order (Deliver in Salsa shops).

    8.22 For this purpose, enter the postcode or city where you would like the delivery to be made.

    8.23 After requesting delivery to a shop, you will be sent a text message or email that will guarantee the safety of your order and allow you to then pick it up at the selected shop.

    8.24 The consumer will be notified of all the stages of their order via email/text message.

    8.25 We are only responsible for shop deliveries where this delivery method is requested directly at the website.

    8.26 Deliveries may not be rescheduled at Salsa shops via the carrier.

    *This delivery and return service is not available in establishments that sell Salsa products (e.g. El Corte Inglés, Galeries Lafayette, etc.). To find out which shop you can return your order to, please see the Shops section.

     

    9. Delivery Fees

    9.1 Delivery fees are applied by order.

    9.2 The exact cost of each delivery depends on the destination country. For further details on delivery costs per country, please see the Delivery menu at the website.

    9.3 If a customer places an order whose cost exceeds the minimum order value defined for their country or campaign, the delivery will be made free of charge.


    10. Returns and Cancellations

    10.1 Customers can cancel orders as long as they have not yet been shipped.
    10.2 Information on the order status is only available to customers who have made their purchase as a SalsaStar customer.

    10.3 If you have placed an order without identifying yourself as a SalsaStar customer, you can contact Customer Support.

    10.4 If the customer has identified themselves as a SalsaStar customer when making the purchase, they should first check the order status in the Purchases and Returns menu, located in the left-hand menu in the Customer Area.

    10.5 If the order status does not say “In transit”, it can still be cancelled.

    10.6 However, the customer should contact our Customer Support service.

    10.7 Orders for customised products (Salsa exclusives) cannot be cancelled before shipping, as the customisation process is already underway; this process begins immediately after the order is received.

    10.8 However, the customer may return the order according to the rules and conditions for returns mentioned below.

    10.9 The customer is entitled to return products delivered if these are found to have defects or do not conform to the products purchased.

    10.10 Except if, at the time of purchase, the consumer was duly informed of the non-conformity of the product, and this was expressly accepted, under the applicable legal and regulatory terms.

    10.11 If the product has not been used, the return may be made within 30 days of receipt of the order.

    10.12 If there is a quality issue with the product purchased, up to three years from the date of purchase, or date of delivery for products bought online, Salsa undertakes, in accordance with the legislation in force, to repair or replace the product or to cancel the contract.

    10.13 If the product is repaired, it will have an additional guarantee period of six months for each repair made, up to a limit of four repairs.

    10.14 Guarantee claims must be made in Salsa shops or via customer.care@salsajeans.com.
    10.15 If you are not satisfied with the products you ordered for any reason, they can be returned within 30 days of receipt, provided that:

    • The products have not been washed or worn (unless there is information to the contrary on the product, the customer is allowed to try on clothes and shoes to check the size and shape, but they may not be worn);

    • The products are still in their original condition and the packaging is not damaged (packaging that has been opened carefully will not be considered damaged);

    • The product is complete (e.g. both items in a pair must be returned);
    The following may not be returned:

    • Products that have been tampered with.

    10.16 Products received as gifts may not be returned.

    10.17 In order to make a return in this case, you should contact the person who bought it so that they can make the return, according to the Terms and Conditions for Returns.

    10.18 To exchange one item for another or to change sizes, please follow the steps in Returns.

    10.19 If the reason for your return is a defect or non-compliance with the products ordered, Salsa will pay the shipping and return costs.

    10.20 If your return is for reasons other than a defect or non-compliance with the products ordered, Salsa will not refund shipping costs.

    10.21 However, when making a return, you will be using our carrier. As the costs incurred by Salsa on making the return are the same as the delivery costs, Salsa will not refund the shipping charges initially paid by the customer for that order.

    10.22 Refunds will be made according to the payment method used and for the amount actually paid.

    10.23 If the customer made the payment using a Multibanco reference, they must give their bank details to our Customer Support service when the returns process begins.

    10.24 This indication is necessary for us to repay the money into your account.

    10.25 The customer will receive the refund once the product(s) has (have) been returned and processed.

    10.26 For further information on the returns process and refund time, please see the Help/FAQs section at the website.

    10.27 Please read the help instructions in this section and follow them carefully to avoid unnecessary delays.

    10.28 You can also return your order to a selection of Salsa shops*.

    10.29 To do this, go to the shop and ask a shop assistant to carry out the process for you, or you can do it directly at the website and then go to the selected shop within three days in order to finalise your return.

    10.30 The shop in charge of sending your order to the distribution centre, and then to Salsa, will proceed with your refund or send you an exchange order.

    10.31 You will be notified of all the stages of your order via email/text message.

    10.32 In the same way as shop delivery, you will also be sent a unique code via text message and email to ensure the safety of your order when making a return/exchange in the shop.

    10.33 You can only proceed with your return if you have this code.

    10.34 We only take responsibility for shop returns where this delivery method has been requested directly at the website or made by our staff in the shop.

    *This delivery and return service is not available in establishments that sell Salsa products (e.g. El Corte Inglés, Galeries Lafayette, etc.). To find out which shop you can return your order to, please see the Shops section.


    11. Free contract cancellation

    Consumers have the right to cancel this contract within 14 calendar days without the need to indicate any reason.

    The deadline for free cancellation expires 14 days, counting from the day after the day:

    a) When you or a third party indicated by you, other than the carrier, takes physical possession of the goods; or

    b) For orders where you have acquired several products and the products are delivered separately, when you or a third party indicated by you, other than the carrier, takes physical possession of the last product.

    In order to exercise your right to free cancellation, you must inform us of your decision through a clear statement (for example, a letter sent by post or via email) addressed to:

    You can use the cancellation form, but this is not mandatory.

    You can also fill in and send the free cancellation form, or any other clear statement of cancellation, electronically via our website, www.salsajeans.com.

    If you choose this option, we will promptly send you an email acknowledging receipt of your cancellation request. You can download the document here.

    For the deadline for free cancellation to be respected, your communication need only refer to your exercise of your right to free cancellation and be sent before the end of the cancellation period.

    Effects of free cancellation

    In the event of cancellation of this contract, all the payments you have made will be refunded, including shipping costs (except additional costs arising from your choice of a shipping method other than the least expensive shipping we offer), without undue delay and, in any case, no later than 14 days after the date we were informed of your decision to cancel this contract. We make these refunds using the same method you used in the initial transaction, unless you expressly agree otherwise.

    In any case, you will not have to pay any costs as a result of this refund.

    The refund may be withheld until we have received the returned goods.

    The goods must be returned or delivered to SALSA JEANS, Avenida da Indústria, 511, 4760-706 Ribeirão, in Vila Nova de Famalicão, Portugal, without undue delay and no later than 14 days after the day you informed us of the free contract cancellation.

    The deadline is deemed to have been met if you return the goods before the 14 days have elapsed.

    You must pay the direct costs for the return of the goods.

    You are only responsible for depreciation of the goods arising from use going beyond what you need to check their nature, features and function.

    13. Conditions applicable to Promotional Codes (discounts)

    13.1 When used in accordance with the rules established, a promotional code entitles the user to benefit from a promotion/discount on the purchase of a specific product or set of products during the period indicated/associated with the promotional code/promotional campaign.

    13.2 Promotional codes can be used on online purchases made at the website and in official Salsa shops in the country where the code was issued.

    13.3 Promotional codes may not be sold, exchanged or given away.

    13.4 Customers with a promotional code may not upload this or make it available at any website or by any other means of offering it to the public, giving it away, selling it or exchanging it.

    13.5 Promotional codes may not be used for commercial purposes.
    13.6 The promotional code is connected to the Salsa brand (IVN).

    13.7 The promotional code may not be used in connection with any other brand, company or name.

    13.8 In addition, the promotional code may not be used illegally, abusively or disrespectfully, or in any other way that could harm the reputation of Salsa (IVN).

    13.9 Use of the promotional code is restricted to only one use per product and per order.

    13.10 Promotional codes may not be used in combination with other promotions or special offers.

    13.11 Promotional codes may not be exchanged for cash.
    13.12 Salsa (IVN) has no obligation to reissue or return promotional codes.

    13.13 However, if Salsa (IVN) decides to reissue or return a promotional code, it must have access to the initial promotional code.

    13.14 For this purpose, you must keep a copy of your promotional code, otherwise it cannot be reissued or replaced in the event of loss.

    13.15 In the cases where Salsa (IVN) reissues/returns the promotional code, the discount of this amount can only be used on one purchase of the same value as, or higher than, the discount/promotional code issued.

    13.16 Without prejudice to any other rights Salsa (IVN) may have, it has the right to immediately invalidate the promotional code if Salsa (IVN) has reason to believe that a promotional code is being used: in breach of the assumptions mentioned above, in the event of theft or if Salsa (IVN) has reason to proceed in this manner.


    14. Availability

    14.1 Filling all the orders placed at the website is subject to availability.

    14.2 Salsa (IVN) makes every effort to ensure that all the items advertised for sale at the website are available in stock.

    14.3 However, Salsa (IVN) reserves the right not to accept any orders or to cancel confirmed orders for products that are no longer in stock.

    14.4 In these cases, Salsa (IVN) will inform the customer of this and proceed with refunding the amount paid.


    15. Promotion validity

    15.1 Website offers are valid only for the time when they are displayed there, unless otherwise stated at the website.

    15.2 Salsa (IVN) is not bound to any offer if there are errors or spelling mistakes in prices or other information at the website.

    15.3 Salsa (IVN) reserves the right to cancel any purchase or sale made under the scope of these errors.


    16. Liability

    16.1 Salsa (IVN) will only be liable for damages incurred by the customer if they result from breaches attributable to the contractual obligations of Salsa (IVN) to the customer, or if the liability of Salsa (IVN) arises from applicable law.
    16.2 If the customer incurs damages related to the activity of the website, Salsa's liability will be limited to:

    • Salsa products or other materials that are damaged;

    • Reasonable and verifiable costs incurred by the customer to find the cause and the amount of compensation attributable to the damage;

    • The maximum amount of this compensation (if applicable) will be the price of the products in question.

    16.3 Salsa (IVN) may not be held liable for damages incurred by third parties arising from the use of our products.

    16.4 Salsa (IVN) may not be held liable for damages incurred by the customer arising from misuse of our products.

    16.5 Salsa (IVN) may not be held liable for damages incurred as a result of incorrect information at the website.

    16.6 If the customer incurs damages as a result of gross negligence or intent on the part of Salsa (IVN), none of the limitations in this article shall apply.

     

    17. Governing law

    These general terms and conditions, and all emerging disputes that are related to these general terms and conditions, including their validity, the use of the website or any purchase made at it shall be governed by Portuguese law.


    18. Changes made to the Terms and Conditions by Salsa

    18.1 Salsa (IVN) has the right to change these Terms and Conditions at any time.

    18.2 Customers are subject to the principles and terms in force on the date of their order, unless the law or a competent authority requires any changes to them.


    19. Information on the website

    19.1 Although Salsa (IVN) takes the utmost care when working on the website, information, texts, documents, graphics, videos, music and/or other services may contain errors or be incomplete or incorrect.

    19.2 Salsa (IVN) may not be held liable for any damages arising from the use of (or inability to use) the website, including damages caused by a virus or any inaccuracy or imperfection in the information, unless this damage is a result of intent or negligence by Salsa (IVN).


    20. Registered trademarks and copyright on the website

    20.1 All of the brand names, product names and titles used on the website are registered trademarks or registered names of Salsa (IVN), or registered trademarks and registered names of other holders.

    20.2 Users/customers of the website are not authorised to use or reproduce any one of these registered trademarks or registered names, as this is a breach of the rights of the holders.

    20.3 All things referring to the design, texts, documents, videos, music and/or other services on the website, their selection and organisation, as well as all the software compilation (including applets) and all other materials on the website are the property of Salsa (IVN) and its suppliers.

    20.4 Users/customers are only authorised to electronically copy and print parts of the website if this is necessary for making an order there or for using the website as a source for the purchase.

    20.5 Users/customers are not authorised to make any other use of the website or the information and material on it, including reproduction for purposes other than those mentioned above, modification, distribution or republication.

    20.6 If users/customers wish to use information or materials from the website, they must get prior written authorisation from Salsa (IVN).


    21. General terms and conditions of the Gift Card
    21.1 After the purchase or issue of a Gift Card, it may not be exchanged for cash or refunded by any other type of payment (bank transfer, VISA/Mastercard or PayPal).
    21.2 If you have selected the Gift Card method for your return, this will be sent to the email address on your order as soon as it has been received and verified in our warehouse.
    21.3 Refunds of orders paid for using a Gift Card will always be made using the same method, i.e. a Gift Card.
    21.4 Gift Cards may be used on purchases for more or less than the card balance. If the value of your purchases is higher, you will be asked to pay the remaining amount.
    21.5 If the value of your purchase is lower, the code for your Gift Card will have the remaining amount.
    21.6 Your Gift Card can be used as long as there is a balance on it.
    21.7 For orders of two or more items, the gift card is used proportionally on each one of the items on the order.
    21.8 You can use more than one Gift Card on the same order.
    21.9 You can check the balance on your Gift Cards at any time by accessing your Customer Area, selecting the Profile tab and choosing the “Gift Card Balance” option.
    21.10 Gift Cards can be used to purchase any item, and can also be used with campaigns, discounts and promotions.
    21.11 E-gifts can only be used by registered customers.
    21.12 E-gifts can be used in shops and online.


    22. TAX FREE

    22.1 Tax refunds can be issued for minimum orders of €50 plus VAT, and the customer has two months to make the request.
    22.2 The invoicing address for the order is always the address for delivery of the order (i.e. EU).
    22.3 In order to have your tax refund voucher sent to you, please follow these steps:
    a. download the invoice
    b. take the invoice to Customs and fill in the tax free form
    c. These two documents must be stamped and validated by Customs
    d. Send the following hard copy documents to Salsa’s registered office at IVN- Irmãos Vila Nova, Avenida da Indústria, 511, Apartado 7079, 4760-725 Ribeirão, Vila Nova de Famalicão, Portugal (the customer must keep proof of sending the documents).
    i. Stamped invoice
    ii. Stamped tax free form
    iii. Photocopy of passport
    iv. Bank account number for the refund to be made to


    23. Online dispute resolution
