GENERAL TERMS AND CONDITIONS OF SALE


1. COMMERCIAL POLICY

1.1 The Vendor, Salsa (SLS SALSA ESPAÑA) has products for sale on the www.salsajeans.com website, available only to its final users/customers, i.e. “Consumers”.

1.2 A consumer is defined as any individual acting outside of their commercial, business or professional role. If you are not a consumer, please do not buy any products in our online shop.

1.3 Salsa (SLS SALSA ESPAÑA) reserves the right not to process orders received from users that are not considered consumers, as well as any other orders that do not comply with the vendor’s commercial policy.

1.4 These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of orders placed at the online shop by www.salsajeans.com users from the vendor.

1.5 The consumer must provide the vendor with a correct email/postal address and all their contact details. The vendor may contact them using these data if deemed necessary.

 

2. HOW TO PLACE AN ORDER

2.1 To place an order, you must have an email account.

Placing an order in our online shop is easy:
 1. Find the products you want to buy
2. Add the products to your shopping basket
3. Confirm your order
4. Select the shipping/delivery and payment options.
 5. Check your order
6. Send your order
7. You will receive confirmation of your order by email, with all the details of your order.

We reserve the right not to accept your order or to cancel it even after automatic order confirmation.

Following confirmation of the order, the customer agrees to these general terms and conditions of sale, as well as any other terms and conditions at www.salsajeans.com, including the general terms and conditions of use and the privacy policy.

The vendor may decide not to process orders when there is not a sufficient guarantee that payment will be made, when orders are incomplete or incorrect, or the products ordered are no longer available. In these cases, you will receive an email informing you that the contract has not been executed and that the vendor did not ship the products for reasons which will be specified. If the products presented at www.salsajeans.com are no longer available, the vendor shall inform you of this as soon as possible and return your money.

2.2 Right not to accept an order or to cancel an order.

We reserve the right to cancel any order (an order we have already accepted) in the following (and other) situations, without being obliged to pay any costs:

  • the product is no longer available (any payments made will be returned);
  • the billing information is incorrect or cannot be verified;
  • the order is flagged by our security system as an unusual order or an order that could be fraudulent;
  • we have reason to believe the customer is aged under 16;
  • we have reason to believe that the user is a reseller;
  • we are unable to deliver the order to the address given. 

 

2.3 Data confirmation

Data confirmation may include your address or information on fraud. Suspected fraud will be investigated and prosecuted if necessary. By submitting your order, you are agreeing to the terms and conditions of purchase.


3. PAYMENT METHODS

3.1 The payment methods available can be found in the FAQs menu. We do not accept any other payment methods. Do not attempt to pay using any other method.

3.2 Payment processing

If payment is made via credit card, the amount owed will be deducted from your account as soon as your order leaves our warehouse. If payment is made by credit card, all the details, such as the card number or its validity date, will be sent via encrypted protocol to the company that provides remote electronic payment services, without third parties being able to access these data. These details will only be used by Salsa (IVN) to process your order and to make refunds if products are returned.[RG1] [RG2] [AB3] 

The purchase prices of the products and the transport costs, as indicated in the order form, will be charged to the current account when the products purchased have actually been shipped.

 

4. ORDER SECURITY

4.1 The salsajeans.com shop uses some of the most robust security technology from the encryption platforms available. Your payment information will be encrypted from the moment you log in and until the transaction is processed, and will not be kept on a public server. Although we use encryption software, the security of information transmitted and payments made via the internet cannot be guaranteed. Salsa (IVN) may not be held liable for any harm suffered as a result of using electronic means of communication, including, but not limited to, losses arising from failures or delays in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications, or virus transmission. Payments may only be processed if the information to be used for invoicing can be verified.

 

5. RETENTION OF TITLE

We shall retain ownership of all products until they have been paid for in full.

 

6. PRICING

6.1 The product prices shown on the website include Value Added Tax (VAT). Shipping fees are applied to each order placed. The exact price of shipping will depend on the country the order is shipped and delivered to. For further information on shipping charges by country, please see the Help/FAQs section of the website.

6.2 All prices are in euros. Please note that prices may vary according to the country of delivery. Shipping costs may also be different.

6.3 Price changes

The product prices on the website are subject to change. Salsa reserves the right to change the prices without prior notice. The prices shown at the time of purchase are the prices that will apply to that purchase.

6.4 Pricing errors

Please bear in mind that although website updates are made very carefully, it is possible that pricing information on the website may contain errors. Salsa shall not be bound by this, and reserves the right to cancel your order if an error should occur.
 
7. SALSA (IVN) QUALITY AND GUARANTEE

Salsa does not sell second-hand products, defective products or poor quality products. The main features of each product shown at www.salsajeans.com can be found on each product page. The products offered for sale at www.salsajeans.com may not correspond exactly to the products presented in terms of image and colours due to the computer monitor used. All products have an identification label attached with a security seal. Please do not remove the label from the products you bought if you want to return them. If you decide to exercise your right to return the products bought, Salsa (IVN) has the right not to accept the return of products without their labels, or products that have been altered in relation to their original condition or damaged.

 

8. SHIPPING AND DELIVERY

8.1 delivery - when and where Products are delivered from Monday to Friday. We do not deliver products on certain public holidays. We can only deliver orders if the shipping address is a house or an office in one of the countries listed on the website.

8.2 Somebody must be at the delivery address to accept the order. This service does not include a scheduling or booking option, which means the order will be delivered without prior contact from the carrier. The delivery period is not assured during promotions or sales, at Christmas or when stock runs out.

The order is considered to have been delivered when the delivery receipt is signed at the agreed address.

8.3 Inspecting the delivery On delivery, please inspect the packaging to check for any damage. If the products are found to be damaged, please do not accept the delivery of the order. We will refund your money and all delivery costs as soon as the warehouse receives the returned product. Any complaint about an order not received must be made within 30 days of the date the order was placed. At the end of this period, Salsa cannot be held liable for the loss of the order.

8.4. Deliveries to mainland Spain and the Balearic Islands only

8.5 Shop delivery

There is an option for delivery in a selection of Salsa shops*, which you can find when selecting the delivery method for your order (Deliver in Salsa shops). Enter the postcode or city where you would like the delivery to be made. After requesting delivery to a shop, you will be sent a code by text message or email that will guarantee the safety of your order and allow you to then pick it up at the selected shop. You will be informed of all the stages of your order by email / text message or in your customer area under “Orders and Returns”. We are only responsible for shop deliveries where this delivery method is requested directly on the website. We do not recommend asking the carrier to make any changes to the delivery address.

*to find out which shops you can return your order to, please see the Delivery in the EU section. This delivery and return service is not available in establishments that sell Salsa products (ex: El Corte Inglés, etc.)


9. DELIVERY FEES

9.1 Delivery fees are applied by order and only include mainland Spain and the Balearic Islands (deliveries to the Canary Islands and Ceuta are not included). The exact cost of each delivery depends on the destination country and are shown in the Transport section. In some cases, there may be free delivery campaigns. This information is indicated when the order is confirmed. For further information on shipping prices by country, please see the Delivery section of the website.

 

10. RETURNS AND CANCELLATIONS

10.1 Cancellation request before shipping

Customers can cancel orders as long as they have not yet been shipped. Information on the order status is only available to customers who have made their purchase as a SalsaStar customer. If you have placed an order without identifying yourself as a SalsaStar customer, you can contact Customer Support. If the customer has identified themselves as a SalsaStar customer when making the purchase, they should first check the order status in the Purchases and Returns menu, located in the left-hand menu in the Customer Area. If the order status does not say “In transit”, it can still be cancelled. However, the customer should contact our Customer Support service. Orders for customised products (Salsa exclusives) cannot be cancelled before shipping, as the customisation process is already underway; this process begins immediately after the order is received. However, the customer may return the order according to the rules and conditions for returns mentioned below.

10.2 Returning defective products

The customer is entitled to return products delivered if these are found to have defects or do not conform to the products purchased. Except if, at the time of purchase, the consumer was duly informed of the non-conformity of the product, and this was expressly accepted, under the applicable legal and regulatory terms. If the product has not been used, the return may be made within 30 days of receipt of the order. If a possibly defective product has been worn or used and was bought within three years, the customer can go to an official Salsa shop in the country of purchase or contact the  Customer Area and ask for the product to be repaired. If the return is authorised, the price actually paid for the product will be refunded. For further information on how to make a return and information on refunds, please see the Help/FAQs section on the website. Guarantee claims must be made in Salsa shops or via customer.care@salsajeans.com. If a product is repaired, it will have an additional guarantee period of six months for each repair made, up to a limit of four repairs.

10.3 Returns for any reason

If you are not satisfied with the products you ordered for any reason, they can be returned within 30 business days of receipt. Conditions of acceptance: the products are clean and have not been worn or used; the product is in its original packaging; the product is complete: e.g. both items in a pair must be returned.

 

10.4 Returning gifts

To return a gift, you should contact the person who bought the product so that they can make the return, according to the Terms and Conditions for Returns.

10.5 Exchanging products or sizes

To exchange a product for another or for one in another size, please follow the information in Returns.

10.6 Refunds

If the reason for your return is a defect or non-compliance with the products ordered, Salsa will pay the shipping and return costs. If your return is for reasons other than a defect or non-compliance with the products ordered, Salsa will not refund shipping costs. However, when making a return, you will be using our carrier. As the costs incurred by Salsa on making the return are the same as the delivery costs, Salsa will not refund the shipping charges initially paid by the customer for that order. Refunds will be made according to the payment method used and for the amount actually paid. The customer will receive the refund once the products have been returned and processed. For further information on the returns process and refund time, please see the Help/FAQs section on the website. Please read the help instructions in this section and follow them carefully to avoid unnecessary delays.

10.7 Shop returns

You can also return your order to a selection of Salsa shops*. To do this, go to the shop and ask a shop assistant to carry out the process for you, or you can do it directly on the website and then go to the selected shop within three days in order to finalise your return. The shop in charge of sending your order to the distribution centre, and then to Salsa, will proceed with your refund or send you an exchange order. You will be notified of all the stages of your order via email / text message.

In the same way as shop delivery, you will also be sent a unique code via text message / email to ensure the safety of your order when making a return/exchange in the shop. You can only proceed with your return if you have this code.

We only take responsibility for shop returns where this delivery method has been requested directly on the website or made by our staff in the shop. We do not recommend asking the carrier to make any changes to the delivery address.

*to find out which shops you can return your order to, please see the Delivery in the EU section. This delivery and return service is not available in establishments that sell Salsa products (ex: El Corte Inglés, etc.).

 

11. Free contract cancellation 

Consumers have the right to cancel this contract within 14 calendar days without the need to indicate any reason.

The deadline for exercising your right of cancellation expires in 14 days, counting from the day after:

a) the date when the consumer or a third party they have indicated, other than the carrier, takes physical possession of the products; or

b) for orders where you have acquired several products and the products are delivered separately, the date when the consumer or a third party they have indicated, other than the carrier, takes physical possession of the last product.

In order to exercise their right of cancellation, consumers must inform us of their decision through a clear statement (for example, a letter sent by post or via email) addressed to:

Consumers can use our cancellation form, but this is not mandatory.

There is also the option to fill in and send the free cancellation form, or any other clear statement of cancellation, electronically via our website, www.salsajeans.com.

If you choose this option, we will promptly send you an email acknowledging receipt of your cancellation request. You can download the document HERE[BAA4] [RG5] [AB6] [RG7] [AB8] 

For the deadline for free cancellation to be respected, your communication need only refer to your exercise of your right to free cancellation and be sent before the end of this period1.



11.1 Effects of free cancellation

In the event of cancellation of this contract, all the payments you have made will be refunded, including shipping costs (except additional costs arising from your choice of a shipping method other than the least expensive shipping we offer), without undue delay and, in any case, no later than 14 days after the date we were informed of your decision to cancel this contract.

We make these refunds using the same method you used in the initial transaction, unless you expressly agree otherwise.

In any case, you will not have to pay any costs as a result of this refund.

We reserve the right to withhold the refund until we have received the returned goods.

The goods must be returned or delivered to SALSA JEANS, Avenida da Indústria, 511, 4760-706 Ribeirão, in Vila Nova de Famalicão, Portugal, without undue delay and no later than 14 days after the day you informed us of your decision to cancel the contract.

The deadline is deemed to have been met if you return the goods before the 14 days have elapsed.

You must pay the direct costs for the return of the goods. You are only responsible for depreciation of the goods arising from use going beyond what you need to check their nature, features and function.

13. PROMOTIONAL CODES / VOUCHERS

13.1 A promotional code entitles the user to benefit from a one-time promotion/discount on the purchase of a specific product or set of products during the period indicated on the promotional code.

13.2 Promotional codes can be used on online purchases made on the website and in official Salsa shops in the country where the code was issued. Promotional codes may not be sold, exchanged or given away. Customers with a promotional code may not upload this or make it available on any website or by any other means of offering it to the public, giving it away, selling it or exchanging it. Promotional codes may not be used for commercial purposes.

13.3 The promotional code is connected to the Salsa brand (Salsa España). The promotional code may not be used in connection with any other brand, company or name. In addition, the promotional code may not be used illegally, abusively or disrespectfully, or in any other way that could harm the reputation of Salsa.

13.4 Salsa (Salsa España) has no obligation to reissue or return promotional codes. Promotional codes will not be reissued or replaced in the event of loss. 

13.5 Salsa (Salsa España) has the right to immediately invalidate the promotional code if there is reason to believe that a promotional code is being misused.

13.6 In the cases where Salsa (Salsa España) reissues/returns the promotional code, this discount can only be used on one purchase of the same value as, or higher than, the discount/promotional code issued.

13.7 Without prejudice to any other rights Salsa (Salsa España) may have, it has the right to immediately invalidate the promotional code if Salsa (Salsa España) has reason to believe that a promotional code is being used: in breach of the assumptions mentioned above, in the event of theft or if Salsa (Salsa España) has reason to proceed in this manner.

 

14. AVAILABILITY

We make every effort to ensure that all the items advertised for sale on the website are available in stock. However, Salsa reserves the right not to accept any orders or to cancel confirmed orders for products that are no longer in stock. If the products your ordered are not available, you will be informed by email or by phone.

 

 

15. WEB OFFERS AND PROMOTIONS15.1 Online offers are valid only for the time when they are displayed there.

15.2 Website offers are valid only for the time when they are displayed there, unless otherwise stated on the website. Salsa (Salsa España) is not bound to any offer if there are errors or spelling mistakes in prices or other information on the website. Salsa (Salsa España) reserves the right to cancel any purchase or sale made as a result of these errors.
15.3 If the customer suffers harm related to the activity of the website, Salsa's liability will be limited to:

a. damage to Salsa jeans or other materials;

b. reasonable and verifiable costs incurred by the customer.

The maximum amount of this compensation (if applicable) will be the price of the products in question.

15.4 We may not be held liable for harm suffered by third parties arising from the use of our products.

15.5 We may not be held liable for harm suffered as a result of incorrect information on the website.


16. GOVERNING LAW

THE GOVERNING LAW IN THE EVENT OF A DISPUTE SHALL BE SPANISH LAW.

These terms and conditions and any other contract that may be entered into as a result of them are governed by Spanish law.


17. RIGHT TO CHANGE THE TERMS AND CONDITIONS
We reserve the right to change these Terms and Conditions at any time.


18. INFORMATION ON THE ONLINE SHOP

Although Salsa (IVN) takes the utmost care when working on the website, information, texts, documents, graphics, videos, music and/or other services may contain errors or be incomplete or incorrect. Salsa (IVN) may not be held liable for any damages arising from the use of (or inability to use) the website, including damage caused by a virus or any inaccuracy or imperfection in the information, unless this damage is a result of intent or negligence by Salsa (IVN).
 
19. REGISTERED TRADEMARKS AND COPYRIGHT

All of the brand names, product names and titles used on the website are registered trademarks or registered names of Salsa (IVN). The use or reproduction of other registered trademarks or registered names is not permitted. Salsa (IVN) reserves the right to the entire design of the online shop (web pages), the texts, documents, videos and/or other services and all software compilations, underlying source code, software (including applets) and all other materials on this website. Only the information needed for making a purchase may be copied and printed. The information and material on this website may not be used for any other purpose, including reproduction for the purpose of modification, distribution or republication. If you wish to use information or materials from the website, you must get prior written authorisation from Salsa.

 

20. GENERAL TERMS AND CONDITIONS OF THE GIFT CARD (ONLINE GIFT CHEQUE)

After the purchase or issue of a Gift Card (online gift cheque), it may not be exchanged for cash or refunded by any other type of payment (bank transfer, VISA/Mastercard or PayPal).

  • If you have selected the Gift Card (online gift cheque) method for your return, this will be sent to the email address on your order as soon as the returned product has been received and verified in our warehouse.
  • Refunds of orders paid for using a Gift Card will always be made using the same method, i.e. a Gift Card.
  • Gift Cards may be used on purchases for more or less than the card balance. If the value of your purchase is higher, you will be asked to pay the remaining amount.  If the value of your purchase is lower, the code for your Gift Card will have the remaining amount. Your Gift Card can be used as long as there is a balance on it.
  • For orders of two or more items, the gift card is used proportionally on each one of the items on the order.
  • You can use more than one Gift Card on the same order.
  • You can check the balance on your Gift Card at any time by accessing your Customer Area, selecting the Profile tab and choosing the “Gift Card Balance” option.
  • Other campaigns, discounts and promotions do not apply to the purchase of a Gift Card.
  • Gift Cards can be used to purchase any item, and can also be used with campaigns, discounts and promotions.
  • Gift Cards can only be used by registered customers.
  • Gift Cards can be used in Salsa shops and the online shop.

 

21. TAX FREE

Tax refunds can be issued for minimum orders of €50 plus VAT, and the customer has two months to make the request. The invoicing address for the order is always the address for delivery of the order (i.e. EU).

In order to have your tax refund voucher sent to you, please follow these steps:

a. download the invoice

b. take the invoice to Customs and fill in the tax free form.

c. these two documents must be stamped and validated by Customs.

d. send the following hard copy documents to Salsa’s registered office (the customer must keep proof of sending the documents).

iii. Photocopy of passport

iv. Bank account number for the refund to be made to
