1.General Terms and Conditions


This document sets forth the General Terms and Conditions that define the characteristics and terms of use of SALSA's loyalty programme, known as “SalsaStar” (“Loyalty Programme”), for customers (“Customers” or “Customer”).

 

The Loyalty Programme shall be governed by the general terms and conditions set forth below, which Customers agree to when giving their consent.

 

SALSA reserves the right to confirm a Customer’s identity under the Loyalty Programme (when making purchases, returns, earning balance, using associated benefits, etc.).

 

The Loyalty Programme is free of charge and allows Customers to:

  • receive discount vouchers on their first purchase, on the amount of purchases made, on their birthday and in other specific programme campaigns, as provided for in section 4;
  • earn stars for interactions with the brand to gain access to experiences, personalised products, benefits from partners and other offers, as provided for in section 4 (not applicable to customers in the USA market);
  • early access to products and promotions, among other benefits. 

 

By joining the Loyalty Programme, Customers consent to SALSA:

 

  • Sending marketing communications with information on new products, campaigns and on the Loyalty Programme itself;
  • Collecting information regarding the use of its products and services;
  • Carrying out individualised and automated analyses of information and shopping profiles aimed at introducing the best campaigns and offers;
  • Carrying out data processing exclusively for Loyalty Programme management, including segmentation analyses and customer management.


Customers may withdraw their consent at any time, in the Customer Area of the online SALSA shop at www.salsajeans.com, at the SALSA shops identified in Annex 1 or by sending an e-mail to Customer Support at customer.care@salsajeans.com.



2. Ownership/Notifications

 

Customer accounts are personal and non-transferable.

SALSA and the Customer expressly acknowledge the validity of communications made between them provided these are through the online SALSA shop at www.salsajeans.com, through the SALSA shops identified in Annex 1 or through the contacts provided by the Customer (e-mail, telephone or address) and previously consented to by the Customer, in accordance with section 8 of SALSA's Privacy Policy.

 

Notification will be sent on at least the following: (i) news about SALSA products, campaigns, promotions or activities; (ii) attribution or enhancement of Loyalty Programme benefits; (iii) reminders of upcoming expiration dates of Loyalty Programme benefits; (iv) any other notices that directly or indirectly affect the development of the Loyalty Programme.

 

SALSA shall not be liable for any consequences resulting from failure in communication with the Customer when such is due to incorrect information provided by the Customer.

 

SALSA cannot guarantee the availability and continuity of the Loyalty Programme, particularly in the event of the technical malfunction of computer systems, servers or equipment, destruction of data by hackers or errors, or any other technical problems that may occur or other factors beyond SALSA's control.

 


3.  Obligations

 

The Customer undertakes to:

  • be bound by the Terms and Conditions of the Loyalty Programme;
  • keep the information associated with their Customer account up to date, under the terms provided for in section 2 on Ownership/Notifications.

SALSA undertakes to:

  • be bound by the Terms and Conditions of the Loyalty Programme;
  • respect the Privacy Policy defined in accordance with the General Data Protection Regulation, Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016;
  • keep the amounts of balance earned, vouchers, stars (not applicable to customers in the USA market) and any other benefits available up to date, as well as any other individual Customer information regarding the Loyalty Programme;
  • notify Customers of interruptions to the operation of the Loyalty Programme when this is relevant and possible.


4. How the Programme works

 

  1. Joining the Loyalty Programme

 

The Loyalty Programme is for individuals aged over 18. SALSA reserves the right to request that Customers supply a document proving their age.

 

Joining the Loyalty Programme is free of charge and can be done in three different ways:

  • Online: by filling in the online form at www.salsajeans.com and expressly agreeing to the Terms and Conditions and the Privacy Policy
  • In person: at the SALSA shops identified in Annex 1, where Customers must provide the sales assistant with the information required for filling in the Loyalty Programme registration form. To complete the process, the Customer must confirm the information and agree to the Terms and Conditions and Privacy Policy
  • Through Customer Support: by contacting Customer Support at customer.care@salsajeans.com or using the additional contact methods indicated at www.salsajeans.com

Within 24 hours of registration, the Customer will be sent confirmation of joining the Loyalty Programme, in accordance with the provisions of section 2, with a copy of the Terms and Conditions and Privacy Policy they accepted, which are also available electronically and can be accessed at any time at www.salsajeans.com.

 


  1. Voucher Allocation

 

Customers shall be entitled to receive vouchers as soon as they register with the Loyalty Programme.

Customers can get vouchers:
  • on their first purchase (i) at the SALSA shops identified in Annex 1 and (ii) in the online SALSA shop at www.salsajeans.com;
  • for balance earned on purchases made (i) at the SALSA shops identified in Annex 1 and (ii) in the online SALSA shop at www.salsajeans.com to be converted into a voucher when reaching multiples of 10 (e.g. 10, 20,30). For customers in the USA market, the value of the accumulated balance reaches multiple levels of 15$ (e.g.: 15$, 30$, 45$);
  • on their birthday, based on the birthdate indicated;
  • for specific Loyalty Programme campaigns.

 

Vouchers cannot be transferred or exchanged for cash.

 

When making a purchase, Customers must ensure that their purchase is registered to their account.

 

If Customers make a purchase as an unregistered Customer, benefits will not be added to their account.

 

SALSA has no obligation to re-issue, restore or extend the validity of vouchers issued.




  1. Welcome voucher

This voucher is issued after Customers make their first purchase (i) at the SALSA shops identified in Annex 1 and (ii) in the online SALSA shop at www.salsajeans.com and shall be valid for 60 days.



  1. Earning Balance

Customers shall be entitled to earn balance as soon as they register with the Loyalty Programme.

 

Customers can earn balance on the amount of purchases made (i) at the SALSA shops identified in Annex 1 and (ii) in the online SALSA shop at www.salsajeans.com.

 

Balance earned on purchases (i) at the SALSA shops identified in Annex 1 and (ii) in the online SALSA shop at www.salsajeans.com will be allocated to the Customer's account on payment and shall be valid for 180 days.

 

Balance will not be earned on the amount of purchases paid for using Gift Cards or refund coupons.

 The amount paid for packaging material or for transporting products purchased at Salsa stores, namely bags and envelopes, will not be considered for accumulating the balance.

Balance will not be earned on the amount paid for any service provided by Salsa, particularly the mending of hems or the delivery of purchases bought in the online SALSA shop at www.salsajeans.com.

The amount of purchases made shall be converted into balance by taking into account the total amount paid and rounding it off to two decimal places.

 

Customers can earn balance on purchases made during campaigns and promotions, unless otherwise stated in their respective general terms and conditions.

When the accumulated balance reaches multiples of €10 (e.g. €10, €20, €30), it will be converted into a voucher, which shall be valid for 60 days after the conversion date. For customers in the USA market, the value of the accumulated balance reaches multiple levels of 15$ (e.g.: 15$, 30$, 45$).


 


  1. Birthday voucher

The voucher issued to celebrate a Customer's birthday will only be allocated if the Customer has registered or made purchases in the 12 months before their birthday, based on the birthdate they indicate.

 

The birthday voucher shall be allocated on the first day of the month of the birthdate indicated by the Customer and must be used by the end of that month.

If a Customer registers after the first day of the month of their birthday, the voucher will be allocated within 48 hours of registration and remain valid until the end of that month.

If a Customer who has not made any purchases in the 12 months before their birthday makes a purchase after the first day of their birthday month and during that month, the voucher will be allocated within 48 hours of the purchase and remain valid until the end of that month.

Birthday vouchers are only allocated once a year. If a Customer changes their birthdate after the birthday voucher has been allocated that year, a birthday voucher will be allocated again the following year.


  1. Using Vouchers

Vouchers obtained according to section 4(b) may only be used on purchases of €29.90 ($49.90 for Customers in the USA market) or more made (i) at the SALSA shops identified in Annex 1 or (ii) in the online SALSA shop at www.salsajeans.com .

If a purchase includes products from the SALSA shops identified in Annex 1 and products from the online SALSA shop at www.salsajeans.com, the balance can only be used in the sales channel or channels identified in Annex 1 on purchases of €29.90 ($49.90 for Customers in the USA market) or more.

Vouchers may be used on purchases of a lower value than that of the vouchers. In this case, the Customer will not have to pay anything and the difference between the value of the voucher and the amount of the purchase will remain available in the form of a voucher.

These vouchers may not be used to purchase Gift Cards.

The terms of use of vouchers on purchases made during campaigns or promotions will be defined in their respective general terms and conditions.



  1. Voucher Deduction

The value of the vouchers obtained according to the provisions of section 4(b) may be deducted in the event of: 

  • Expiration: vouchers have expiration dates that vary according to the underlying reason for their allocation. When a voucher expires, the expired amount will be deducted from the Customer's account
  • Use on purchases: when a Customer makes a purchase using a voucher, the amount used will be deducted from the Customer's account.


  1. Deducting amounts from the accumulated balance

 

Balance earned according to the provisions of section 4(d) may be deducted in the event of:

  

  • Expiration: balance earned is valid for 180 days. When the balance expires, the expired amount will be deducted from the Customer's account.
  • Return of the original purchase: when Customers return all or part of a purchase, the balance earned for the returned product(s) will be deducted from the Customer's account.
  • Conversion into a voucher: when the accumulated balance reaches multiples of €10 (e.g. €10, €20, €30), this amount will be deducted from the Customer's account when it is converted into a voucher. For customers in the USA market, the value of the accumulated balance reaches multiple levels of 15$ (e.g.: 15$, 30$, 45$).



  1. Earning Stars (not applicable to customers in the USA market)

 

Customers shall be entitled to earn stars as soon as they register with the Loyalty Programme.

 

The value of stars earned by the Customer is non-transferable.

 

Customers can earn stars for certain activities specified in the Customer Area of the online SALSA shop at www.salsajeans.com or through specific Loyalty Programme campaigns. 

 

The value of the stars allocated for each activity can be confirmed in the Customer Area of the online SALSA shop atwww.salsajeans.com.

 

Each activity that gives rise to earning stars may have an associated allocation limit during a certain period of time, as specified in the Customer Area of the online SALSA shop at www.salsajeans.com


In case there's a union of Customer accounts, the stars from the account being united will be transferred to the new account if they were earned by sharing an opinion, as specified in the customer area in the SALSA online shop, at www.salsajeans.com and/or if they were earned from the selection of delivery/ returned at physical SALSA stores or pick-up points. Any other stars awarded will not be transferred to the new account.


SALSA reserves the right to add, change or cancel the activities that give rise to earning stars, the value of stars to be earned by taking part in these or the associated allocation limits at any time and without prior notice.

 



  1. Redeeming stars (not applicable to customers in the USA market)

Customers can redeem stars earned for the benefits specified in the Customer Area of the online SALSA shop at www.salsajeans.com.

In order to redeem stars earned for the benefits specified, Customers should read the instructions available in the Customer Area of the online SALSA shop at www.salsajeans.com.

 

The number of stars needed to acquire each benefit can be confirmed in the Customer Area of the online SALSA shop at www.salsajeans.com.

 

When a request is made for the acquisition of a benefit, the corresponding number of stars will be deducted from the Customer's account.

 

The benefits will be attributed in the order the requests for them are received and may be limited to the stock available. SALSA reserves the right not to accept any requests or to cancel previously confirmed requests for benefits not in stock or unavailable. In these cases, SALSA will inform the Customer and return the stars deducted when the request was made.

 

SALSA reserves the right to refuse to attribute any benefit for any reason. It also reserves the right to cancel any request, even if it has already been confirmed, and shall not be held liable for any associated costs or losses. In these cases, SALSA will inform the Customer and return the stars deducted when the request was made.

 

The Customer must pay any fees or other legal costs that may be incurred with the acquisition of the benefits requested.

 

The benefits acquired by the Customer in exchange for stars are non-transferable.

 

SALSA reserves the right to add, change, suspend or cancel the available benefits, the number of stars necessary to acquire them and the conditions for their acquisition at any time without prior notice.



  1. Product Returns

If the product(s) returned are refunded through a refund coupon, the balance earned on the purchase of the product(s) will not be changed. Otherwise, the balance earned will be deducted.

If a voucher was used to pay for the purchase being returned, the value used on the product(s) returned will be refunded to the Customer's account. The amount returned will be converted into another voucher and shall be valid for 60 days.



  1. Checking your balance, vouchers, stars and other benefits

Customer may check the value of balance earned, vouchers, stars and other benefits attributed under the Loyalty Programme (i) in the Customer Area of the online SALSA shop at www.salsajeans.com, (ii) at the SALSA shops identified in Annex 1 or (iii) by sending an e-mail to Customer Support at customer.care@salsajeans.com. Note: in the USA market, star consultation is not applicable.



5. Cancellation


In the event of non-compliance by a Customer with these General Terms and Conditions, SALSA shall be entitled to cancel that Customer’s account.

Customers may cancel their registration with the Loyalty Programme at any time, by notifying SALSA using one of the following methods: (i) by sending an e-mail to Customer Support at customer.care@salsajeans.com, (ii) by sending a letter to the Data Controller using the contacts mentioned in SALSA's Privacy Policy or (iii) in the Customer Area of the online SALSA shop at www.salsajeans.com

Cancellation of a Customer’s account will immediately imply the loss of all the rights associated with the Loyalty Programme.

SALSA reserves the right to suspend or cancel the Loyalty Programme at any time and without prior notice. Customers may use their balance and other active discounts until they expire.



6. Amendments

 

SALSA may amend these Terms and Conditions and shall notify Customers thereof. This requirement is deemed fulfilled when the amendments are published in the online SALSA shop at www.salsajeans.com or at the SALSA shops identified in Annex 1.

 

If a Customer does not agree to the amendments, they may cancel their membership of the Loyalty Programme, as per section 5.

 


7. Governing Law

 

Any disputes arising from interpretation, integration, implementation and compliance with these Terms and Conditions shall be governed by Portuguese law and settled by the court of jurisdictions of the District Courts of Braga.

 


 8. Privacy Policy

 

The processing and protection of t the Customer personal data of which

SALSA is Data Controller is in compliance with EU Regulation 2016/679.

The Privacy Policy is available for consultation by Customers when they register with the Loyalty Programme, or at www.salsajeans.com.






ANNEX 1 – SALSA shops participating in attribution of Loyalty Programme benefits


Sales channels and locations where Loyalty Programme benefits are attributed, provided they are in accordance with these general Terms and Conditions.

The Loyalty Programme channels do not include department stores or marketplaces such as El Corte Inglés, Galeries Lafayette, Amazon, La Redoute, and the like.
