Challenge MO88

1. Description

The “SalsaxMO88” challenge is promoted by Irmãos Vila Nova SA, directed at fans of the official website of Salsa Instagram page (https://www.instagram.com/salsaofficial/). By participating, the user accepts the Terms and Conditions of the present rules of the stated competition.

2. Recipients

Anyone aged 18 (eighteen) or over can participate in this competition or age equivalent to the age of majority in their country of origin, provided they recognise and accept all clauses and terms of the rules of the competition and that they have an account on the social network Instagram.

3. Duration

The competition starts on April 5th, 2021 (after its official publication on the Salsa Instagram page), until 12 midday (12.00) on April 7th, 2021.

4. Prize

4.1. One t-shirt signed by MotoGP pilot Miguel Oliveira (Instagram: @88migueloliveira) and one item of the “Salsa x Miguel Oliveira” capsule collection of the winner’s choice will be awarded.

5. Conditions of Participation

The participant must:

- be a follower of the official Salsa Instagram page (https://www.instagram.com/salsaofficial/) and of Miguel Oliveira (https://www.instagram.com/88migueloliveira/?hl=pt )

- tagging and identifying 1 friend in the mentioned post;
- answer correctly a question, if selected;

Both competition participant and tagged friend must be Instagram account holders.

There is no limit on frequency of participation, provided that the identified persons are different.

The tagging or identification of professional pages or accounts of brands / organisations / entities or similar is expressly disallowed. Should this happen, the participant will be disqualified.

By participating, the winner agrees to have their personal data collected and added to our data base for marketing purposes according to point 8.1. of this regulation.

6. Method of awarding of the prize

One entry will be selected through a random draw (https://commentpicker.com/) and needs to meet all requirements stipulated for the challenge.

Then the winning entry for the competition will be selected on a meritorious basis. The randomly selected participant needs to answer correctly the question “The checked flag - embroidered on the Salsa x Miguel Oliveira collection - means glory to the rider who sees it first. What's the first MotoGP Miguel has ever won?”. After the competition participation period has ended, the following steps will be taken according to the aforementioned participation criteria:

- random participant draw;

- validation of randomly selected participant’s entry and confirmation that said profile is a follower of the official Salsa and Miguel Oliveira’s Instagram pages;

Provided all criteria are met, the randomly selected participant of the competition will be contacted to answer the question. If the answer is correct the winner will then be announced.

If they do not meet any given regulation of the criteria, a new entrant will be chosen, following this procedure successively, until an eligible competition winner is announced.

Only one winner will be selected.

7. Prize delivery

7.1. The winner will be contacted via Private Message on Instagram and must send the requested details (name and e-mail address) by 2 pm on the day following the sending of the winner’s announcement message. In the case that details are not sent on or before the stipulated date and time, said winner will automatically lose their access to the prize and other winner will be selected.

7.2. Once the winner gives Salsa the information needed for the prize (such as chosen items, sizes, addresses, e.g.) it is not possible to change it.

7.3. It is not possible to convert prizes into cash.

8. Protection of Personal Data

8.1. The winner is obliged to provide Salsa with personal data strictly necessary for participation in the competition, such as name, email and clothing sizes. The collection and processing of this data sets out to make contact with the winning participant and manage the delivery of prize of the contest.

In addition, we will add it to our database for email marketing purposes. Your consent, as the data subject, will be an indispensable condition for participation in the competition.

8.2. If the winner chooses not to provide this data, their participation in the competition will not be feasible, since the collection and processing of personal data constitutes an essential requirement.

8.3. The personal data will be collected and processed by Irmãos Vila Nova, S.A. with headquarters based at Av. da Indústria, 4760-511, Vila Nova de Famalicão.

8.4. Salsa deems it necessary to share your personal data internally and to third party external service providers that perform functions on behalf of Salsa, such as companies that manage Salsa advertisements.

8.5. We draw your attention to the fact that your data can be communicated when: (i) the transfer is made within the scope of the fulfillment of an obligation legal basis, a resolution of the National Data Protection Commission or to compliance with a court order; (ii) the communication is carried out for any legally intended purpose; (iii) for detecting and protecting against fraud, or any technical or security vulnerabilities; and (iv) to protect the rights, property, warranties, or safety of third parties, website visitors.

8.6. As the holder of your personal data, you are guaranteed a series of rights in relation to your personal data and the way it is treated, namely the right to opposition, information, access, rectification, limitation, right to elimination, portability of your personal data and the right to withdraw your consent. The personal data holder is also entitled to complain to the supervisory authority about how their personal data is treated. The exercise of any of the aforementioned rights must be made through contact with Salsa, by sending a letter to the above address.

8.7. The personal data collected will be processed by Salsa and by third parties of the same, contracted by it for the continuation of the respective activity and fulfillment of the competition, until the end of it and full compliance with the obligations provided for here are met, after which measures will be taken to ensure that it is properly and permanently deleted or anonymised and shall be preserved in an agreement and for the period provided for by applicable law.

8.8. Salsa and the third parties contracted by it, with legal and / or contractual  legitimacy for the purpose, acting under its name or on its behalf, will treat personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, and with national legislation governing the protection of personal data, in force at all times, to the extent strictly necessary to ensure only the fulfillment of their duties, as well as for the exercise of their rights stipulated under the competition.

9. Additional information

9.1. Facebook or Instagram accounts visibly opened solely for the purposes of participation will not be considered in the competition.

9.2. Salsa reserves the right to exclude, without prior notice, participation carried out using false, inaccurate or incomplete registration details, or that which violates Instagram community rules on Salsa Jean’s Instagram page.

9.3. Participation implies knowledge and acceptance of the characteristics and limitations of Internet usage regarding the lack of protection of certain data resulting from the possible appropriation and piracy or risks of contamination by viruses circulating on the network, technical performance, response times for consultation, research or transfer of information, the risks of interruption and, more generally, the risks inherent to any Internet connection and transmission.

9.4. The company promoting this competition declines any responsibility for errors in the transmission of information and / or interruptions or delays to the same caused by incorrect data entry or by malfunctions and technical deficiencies in communication systems and /or  computer systems.

9.5. The promoting company cannot be held responsible in the event of the occurrence of events that are deemed force majeure (strikes, bad weather, etc.), that fully or partially deprive participants of the opportunity to participate in the competition and / or the winner to benefit from their prize.

9.6. Salsa cannot be held responsible for incidents that occur after the awarding of prizes to participants, nor will it have any responsibility for any physical or psychological damage suffered by the participants when enjoying the awarded prize.

9.7. Salsa will not bear any costs associated with the enjoyment of awarded prizes, beyond those which are already provided for.

9.8. Salsa will not be held responsible for entries not received or unrecognized or late entries from participants, which will not be taken into account for the purposes of the Competition.

9.9. Salsa reserves the right to:

a) Eliminate any participant who behaves in an improper or unacceptable fashion during or after the competition or that violates any of the conditions of participation;

b) Take the necessary decisions for the normal running of this competition, these being expressly accepted by each of the participants;

c) Change the conditions stipulated in this regulation notice at any time, without giving prior notice, provided that the changes are duly publicised;

d) Suspend at any time, temporarily or permanently, or cancel, the present competition.

9.10. Any doubts about the interpretation and application of the regulations of this competition should be clarified and analysed through consultation with Salsa.
